Judicial Review

Judicial Review (JR)- Immigration Canada.

A judicial review in immigration is a process where a court of competent jurisdiction (Federal Court) in Canada reviews an officer's administrative and decision process in deciding a particular case. The soundness and reasonableness of their decision in law and fact are scrutinized during this process.   

If your application is refused, and you believe (concrete) that the officer may have erred in their decision, Judicial Review may be the route to take. 

Below is the Federal Court Process (Judicial Review)

1. The Lawyer will review the submitted application package and the refusal letter.

2. The Lawyer will give their recommendations if the case is worth fighting.

3. The client accepts if they want to proceed with the JR application.

4. The Lawyer will then submit notice to any federal court in Canada

5. The Court will inform the Counsel to IRCC (Immigration)

6. The counsel to IRCC will respond with an abstract of the GCMS note.

7. The Lawyer will respond to it with a comprehensive submission inclusive of the original application and an affidavit from the applicant.

8. The Court will share the submission with the Counsel to IRCC.

9. The Counsel to IRCC will have a few weeks to call for an out-of-court settlement or proceed with the court hearing.

10. If the Counsel to IRCC decides to settle, they will inform the applicant's Lawyer.

11. The Lawyer to the applicant will inform the applicant.

12. If the applicant accepts the settlement, the Counsel to IRCC will then send the case to be assessed by another officer.

13. But If the Counsel to IRCC decides to proceed with a court hearing.

14. The case will be heard before a judge and decided.
